Who should be the main EB-5 applicant facing retrogression?

Hello, my name is Vaughan de Kirby, and I am an Investment Immigration Attorney. One of the questions that is coming up often right now is the effect of retrogression.  Rather than try to predict what will happen, how long it will be, which is almost impossible at this point, what I would like to do is give you some information that will help you and protect your children.

Simply, if your child is 18 or older and you’re filing an application to benefit that particular son or daughter, I recommend that son or daughter become the main applicant. If you speak directly with your Investment Immigration Attorney on this issue, he or she will explain this to you, and make sure that Green Card is available for that child. It’s very important.

So my final recommendation again is if your child is 18 or older, make them the main applicant for your application. I hope this is helpful.
