Hello, I’m Vaughan de Kirby, Investment Immigration Attorney based here in San Francisco.
I wanted to address the question of whether the future changes in EB-5 are real. I want you to know they are. It doesn’t mean that I want to be alarmist and I want you to take action that’s not right for you, but I want you to know what’s happening.
Right now the changes that USCIS proposed are with the Federal Office of Management and Budget. That is almost the last step for those regulations to become reality. If they become reality, the key change that will affect you is an increase of the investment amount to the sum we believe at $1.35 million.
Now this is a substantial increase. Will it happen tomorrow? No. Will it be happening some time in the future? Yes I believe so and I believe it will happen relatively soon. We will have some notice, but that notice could be as little as 30 or 60 days. So if EB-5 is important to you, work with your Investment Immigration Attorney and get your application filed under the law as it exists today, because it is not going to be the same in the future.
I hope that’s helpful to you. Please feel free to contact us or call 415-221-2345 if you have any questions. We're here to help!
