Sealing Wrongful Arrest Record In Time

Hello, I’m Vaughan de Kirby. I’m an investment immigration attorney based here in San Francisco. I wanted to tell you about something that just came up today. A client came to me and they explained to me that they had a wrongful arrest. However, it still shows up when they come into the United States. And I wanted to tell you how to address this problem. You should speak with a criminal law specialist in order to do this, but these are the requirements that you’re going to need to show.

You’re going to need to show that 1. Your arrest was wrongful. It was done incorrectly. 2. You’re going to need to show that the arrest did not result in any criminal charges. Lastly, which is very important, you must make application to have your arrest record sealed within two years, or show reasonable cause why you were unable to do that.

If you have a wrongful arrest record, or any wrongful detention record in the United States, and you have a Green Card, and you’re going to be entering the United States, I recommend that you carry with you a certified copy that you can obtain from the court. I hope this information is helpful.
