Hello, I’m Vaughan de Kirby. I’m an investment immigration attorney based here in San Francisco. A subject that is in all our minds, if we’re either considering EB-5, or if you’re like me, it’s a big part of my practice, is what’s going to happen after April 28th.
Well, there’re a number of possibilities. NO. 1 you need to know the law is set to sunset on April 28th. We certainly hope and anticipate the law will be extended, continued, or renewed.
We don’t know whether Congress will decide to actually enact a new version of EB-5, and make the changes, both from the Regional Center perspective and important for you for the investment amount.
As you know, Homeland Security has suggested they raise the investment amount to $1.35 million. We don’t anticipate this is going to be happening very soon after the 28th, but it’s something to be aware of.
We recently had a judiciary meeting in the House of Representatives, and we saw a lot of energy for changes to EB-5, so those changes are going to happen, but whether they will happen immediately after the 28th or beyond, we really don’t know.
So the key message is if you’re interested in EB-5, if it’s something really important to you, your family and your future, now is really the time to consider applying, because we know what the law is today, but we really don’t know what the law will be tomorrow.
