Travel Ban’s Effect on EB-5 Applicants

President Trump’s immigration agenda has caused a great deal of uncertainty for many EB-5 applicants.

As you may have heard, President Trump has wielded his executive power with the goal of restricting immigration from certain countries—those his administration has deemed a source of terrorism. For example, he recently signed a new executive order on March 6, 2017, restricting travel from six predominantly Muslim countries. The new “Muslim ban,” as President Trump’s travel bans have been called by critics, was issued because the last one was blocked by a federal judge. This most recent executive order has likewise been temporarily blocked and is now being adjudicated in federal court.

According to the recent executive order, citizens of Iran, Syria, Somalia, Yemen, Libya, and Sudan would be prohibited from entering the US for a period of 90 days (Please note the ban has been temporarily blocked). However, citizens of these countries who are already US permanent residents or have approved visas would not be barred from entering the country. Therefore, if you are an EB-5 applicant from one of these countries and have already received a US immigrant visa on your passport, any such travel ban would not affect you—you would be allowed to enter the US.
