EB-5 Visa Applicants: Are You Who You Say You Are? What Kind of Proof the USCIS Is Looking for

If you are planning to apply for an EB-5 visa, congratulations! You're well on your way to a great life in the United States. As you prepare your application with your EB-5 green card lawyer, you will need to make sure you have all of the proper documentation to prove your identity. The USCIS does not kid around when it comes to this, and you can really never give them too much documentation; you must prove your identity beyond a reasonable doubt...so don't give them any reason to doubt it!

  • Five years worth of names and addresses for you, your spouse, and your children
  • Any other names used by you, your spouse, or your children
  • A copy of your passport, as well as your spouse’s and children's passports

  • Educational certificates, where applicable
  • Copy of college degree 
  • Copy of marriage certificate
  • Copy of divorce certificate
  • Copy of household registry
  • Place of birth for you, your spouse, and your children
  • The names and occupations of your parents
  • Proof of whether or not you are a member of the Communist Party
  • Court records of any criminal convictions
  • All dates of entries to the United States, as well as exits, for you, your spouse, and your children. 
  • Certified translations of any documents written in a language other than English
  • Proof of whether or not you have a communicable disease

As you can see, a lot of documentation is required—but it is worth it! EB-5 Regional Center Program Ends 9/30/17

Congress has extended the current Regional Center program to September 30th, 2017, at which time it will sunset unless extended. We anticipate future legislation that will call for an increased investment amount and more stringent requirements. For this reason, we recommend to our clients that they take action under the current law if at all possible.
