My Immigration Lawyer Did Not Do His Job
My Lawyer Didn’t Do His Job
We hear this all too often! We have
found this especially true regarding attorneys from
Your right to a competent attorney is part of your right to “due process” as guaranteed in the 5th Amendment to the United States Constitution. To qualify to get a case reopened the attorney’s actions must be serious enough to amount to a violation of fundamental fairness. You must also show that your rights were lost or damaged by the attorney’s actions.
Let me give you and example we have seen. The individual goes to an immigration consultant to apply for Asylum. At the interview the Asylum Officer denies the grant of Asylum. The immigration consultant then hires an attorney to go to court with the person. The attorney goes to court with the client and gets the date for the Individual Hearing but never tells his client. The attorney then moves his office without telling the client. The result is that the person fails to go to court and the Immigration Judge enters a Deportation Order. Based on these facts we were able to get the case reopened and sent back for a full hearing. We were able to stop the deportation!
These cases can be complex and can only be evaluated by an experienced attorney. If you think you were the victim of an attorney who did not do his job, do not wait call us today. We will carefully go over the facts of your situation and let you know if we think we can help you reopen your case. We do not charge for the consultation because we are committed to your right to fairness.
