The EB-5 Program—There’s Nothing Else Like It

As a path to U.S. immigration, what’s different about EB-5? As we’ll see, the EB-5 visa has a number of significant advantages over other visa categories and immigration programs. The first advantage is that it leads directly to a Green Card. There are other visas types that provide a first step to eventually—if everything goes well—obtaining a Green Card. However, the EB-5 program immediately gives you a Green Card once your petition is approved. Second, the EB-5 program does not limit where you and your family live, work and go to school, as many visa types do. This kind of freedom is rare in immigration law, as most visa types are based on holding a certain job or attending a particular university. Third, with the EB-5 visa, your immigration rights are not dependent on factors that are ultimately outside your control. This isn’t the case with many other paths to immigration. For example, there are several visa categories that are contingent on the success of a business. In these cases, the visa holder’s right to reside in the United States can come to an abrupt end if the business does not perform as anticipated. Third, the EB-5 program—because it gives you a Green Card—qualifies you and your children for the significantly reduced college tuition of a State Resident. In America’s university system, state residents are more likely to be admitted to the state’s universities, and they pay significantly reduced tuition. For many applicants, giving their children the opportunity to go to school in the United States is an important goal of immigrating to the U.S. Most visa types do not qualify you and your family for state residency. The EB-5 program does. And finally, applicants to the EB-5 program enjoy a high rate of success. There are no guarantees in immigration law, but the EB-5 program is by far the most certain route to U.S. residency. So, what’s different about the EB-5 program? The answer? Just about everything.
